Summary This paper represents a comparative study of a right to a fair trial in International Human
Rights Law and International Humanitarian Law. It focuses on the scope of application of both International Humanitarian Law and International Human Rights Law instruments.
Particularly, the situations, when one or the other body of law cannot guarantee fair trials rights, shall be explored. In International Humanitarian Law, these situations mostly arise due to status of individuals and types of armed conflict, and in International Human Rights
Law, these situations evolve due to emergency situations. While talking about these issues, I would like to draw attention where both instruments can co-exist or fill each other as a guarantor of fair trial rights. Also, I want to touch the issue of implementation of both spheres of law. Substance of the right to a fair trial under both fields of law will not be discussed unless it is necessary to illuminate the application of certain right.
