Title Implementation of the Aarhus Convention in Kazakhstan: role of NGOs
Summary Promotion of a participatory democracy in countries-in-transition is topical today. An environmental right should constitute an integral part of a democratic policy agenda. The UNECE Convention on Access to Information, Public Participation in Decision-Making and Access to Justice in Environmental Matters (the Aarhus Convention) is a distinguished international tool establishing a benchmark in environmental democracy. The public and their representative organizations, NGOs, have been given an active role to play in formulation the policies and their implementation to promote a healthy environment.
The study aims to explore the current status of the Aarhus Convention implementation in Kazakhstan. It observes the activities of various actors involved. However, the main attention is given to the role of ENGOs as the mediators between the civil society and the state authorities.
To explore the level of compliance with the Convention provisions, the analysis of the national legislation, various reports and documents was done, available literature reviewed. To get the in-depth assessment of the current affairs, the interviews in the field were conducted. The consultations were made with the experts from a number of organizations, namely ENGOs, MEP, CAREC, OSCE.
The main finding of the research states that despite the environmental legislative acts are in place and the legal compliance ensured in Kazakhstan today, the implementation in its broader meaning has not been yet ensured. There is a room for improvements. As a result of this work, a number of up-to-date recommendations were elaborated. They may find practical application for the experts in the field.
