Summary The treatment of prisoners in a democratic society is an effective measure of that society’s commitment to human rights due to the fact that democratic institutions of elected representation often do not serve prisoners as a constituent group to which elected officials may be held responsible. The American reform of correctional institutions from the 1960-1980’s is a fruitful example of judicial intervention to secure the rights of prisoners. This paper seeks to apply a similar action on the part of the judiciary to the Russian context, to ascertain its applicability and feasibility, where prison reforms would serve to solidify human rights and the authority of the judiciary in the fledgling democracy.
