Title Where Law Ends and Reality Begins: Limits of Successful Litigation in Desegregating Schools in the United States, Czech Republic and Hungary
Summary Access to quality education, a norm for some, is still routinely denied to many Roma throughout Eastern and Central Europe. This paper focuses on the limits of strategic litigation in successfully desegregating education in the United States, Czech Republic and Hungary. By focusing on three different court cases, comparing D.H. and Others v. Czech Republic and Miskolc Desegregation Case with Brown v. Board, this paper will show the successes and failures in Brown as a means to adapt current strategy to optimize results in desegregation education for Roma students.
