Title DAMAGES ACTIONS FOR BREACH OF ARTICLES 81 AND 82 OF THE EC TREATY: A MORE ECONOMIC APROACH
Summary The thesis examines several issues which lay at the intersection between the recent changes in EC competition law policy and the efforts of the European Commission to privatise competition law enforcement. In particular, it examines the relationship between the „more economic approach‟ and damages actions for breach of Article 81 and 82 of the EC Treaty. The thesis is structured into four parts. The first part examines the foundations of EC competition law policy and some of the basic characteristics of its objectives structure before the introduction of the more economic approach. The second part discusses some of the fundamental characteristics of the more economic approach itself. Part three contrasts the findings of the first two parts against the current state of Community law and some of the solutions proposed by the European Commission. Part four concludes.
