Title Enforcement of Foreign Arbitral Award in Nigeria
Summary Considering the importance of arbitration in the settlement of disputes, this work will focus on the effect of the reception accorded the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Award [New York Convention] in Nigeria. A functional analysis of case law and legal regime of international commercial arbitration will be carried out. The aim is to indicate the progressive acceptability of arbitration as an alternative means to solving commercial disputes. It will be examined whether enforcing an arbitral award that is subject to a set-aside proceeding in the country of, or under the laws of arbitral proceedings of another country will be in conflict with the New York Convention. The issue of deference to international arbitral award and the attitude of the national courts to international commercial arbitration in Nigeria as a whole will be analyzed. Finally, some suggestions will be offered on making Nigeria the hub of conducting foreign arbitral proceeding as well as enforcement of such awards.
