Title Annulment of ICSID Awards
Summary Focusing on annulment of ICSID awards – a unique internal, self-contained, but international mechanism of arbitral awards’ review – this paper will firstly talk about control of arbitral awards exercised by state courts covering, inter alia, the cases when this control is unavoidable towards ICSID awards. Then it will proceed to comparison of annulment and appeal. Chapter II will be dedicated to a detailed and complex analysis of the provisions on annulment contained in the ICSID Convention and in the ICSID Arbitration Rules. The undertaken approach shall facilitate a better comprehension of the procedure along with the issues consequential to and accompanying annulment. It shall also fill up the gap in understanding of the elements of annulment procedure which might not be exactly obvious by simply reading Article 52 of the ICSID Convention. Later, on the basis of available decisions on annulment it will be examined what is the current statistics of annulment procedures and what grounds for annulment are invoked by the parties more often. Finally, interpretation of the grounds for annulment foreseen by the Article 52(1) of the ICSID Convention that has been established and upheld by the ad hoc committees will be demonstrated.
