Title Subordinating Justice in Communist Romania: The Sovietization of the Romanian Criminal Justice System (1945-1953)
Summary In this thesis I address the judicial and legal systems of Romania from 1945 to 1953 within the context of the communist tack-over of Sovietization of Romania. More precisely, I discuss the arrangement of the judiciary and several amendments brought to criminal legislation (Penal Code). I argue that during the period under my focus Soviet-type judicial institutions, legal concepts, and practices were transplanted to Romania at different stages. I also argue that beginning in 1948, when a Soviet-type constitution and a new penal code came into effect, the communist government of Romania gave political repression, to a certain extent a legal dimension. Accordingly, my aim is to demonstrate that the repressive nature of the regime was upheld by the ideological interpretation of criminal law.
