Title | ADDING THE CRIME OF INTERNATIONAL TERRORISM INTO THE STATUTE OF INTERNATIONAL CRIMINAL COURT: DEFINITION, BENEFITS TO JUSTICE AND OBSTACLES |
Summary | This paper is based on a theory that a high level of human rights protection could be afforded if the Rome Statute of the International Criminal Court would have been expanded to include the crime of international terrorism. Thus it will recollect and examine views of different actors on a very problematic, yet lacking a universal understanding matter, the definition of the crime as such. It will then elucidate what are the major abuses in respect of fundamental rights of the detainees, suspected in terrorism, by the national authorities. So the contribution of this paper is in novelty of the approach and interpretation of two distinct issues which are, in fact, inextricably correlated and if applied from this perspective, may yield positive results. |
