Title The Introduction of the Concept of the Floating Lien over Inventory in the Russian Federation: Possible Effects on Small Business Financing
Summary This thesis addresses the problem of underfinancing of small business enterprises in the Russian Federation due to imperfections of the legal system of secured transactions and, as a consequence, the imperfection of banking practices. A sample of 44 loans given to small business entities by one of Russian banks has been analyzed to illustrate the problem. To enhance small business crediting changes to the legal system are suggested, in particular, introduction of the concept of the floating lien, which is one of the main features of the American secured transactions system.
The outcome of this thesis is the identification and description of the deficiencies of the current secured transactions system and crediting practices in Russia that inhibit crediting of small businesses, and the estimation of the effects that introduction of the floating lien might bring to the small business financing. This thesis attempts to prove that introduction of the floating lien can enhance crediting activity in Russia and contribute to national economic development.
