Title | United Nations and Council of Europe Anti-trafficking Instruments: Comparative Analysis and Assessment of Implementation in Ukraine |
Summary | The thesis is dedicated to a comparative analysis of the international standards in the areas of criminalization, investigation, prosecution and adjudication of human trafficking crime that were established by the two international anti-trafficking instruments: the UN Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children (the Protocol), and the Council of Europe Convention on Action against Trafficking in Human Beings (the CoE Convention), and their implementation in Ukraine. The author made a thorough evaluation of the international standards and their interpretations, analyzed Ukrainian legislation and practice, interviewed practitioners, and as a result, identified gaps in legislation and flaws in practical enforcement in Ukraine. It is concluded that despite Ukraine has taken some steps towards implementation of the Palermo Protocol and the CoE Convention, more action should be taken to improve the national anti-trafficking regime. In addition there are recommendations giving a road map to the government and civil society on measures to be introduced in the field to comply with international standards. |
