Title | Constitutions and the Right of the National Minorities to Participate in the Electoral Process |
Summary | Asides from being an element of Citizenship, political participation is also an important factor in the integration of ethnic minorities and in maintaining the stability in the multiethnic states. The rights ‘to vote’, ‘to be elected’, and ‘to stand for office’, are rights that most jurisdictions recognize and refer to in their constitutions. Placing restrictions on these rights, based on ethnic considerations, would clearly amount to discrimination. The aim of this thesis is to analyze from a comparative perspective whether a constitution can classify persons according to their ethnic belonging and prevent them from participating in the electoral process. The argumentation will rely on the decision of the European Court of Human Rights in three cases triggering discrimination in political participation and a violation of the European human rights: Sejdić and Finci v. Bosnia and Herzegovina, Aziz vs. The Republic of Cyprus, and Podkolzina v. Latvia. |
