Summary This thesis examines the contemporary theoretical frameworks in claiming rights of indigenous peoples by analyzing the debates around the prevailing ‘no-definition’ approach for indigeneity, the contradictions and complications brought about by the self-determination discourse as well as the concept of minorities. The analysis of this thesis is based on the comparison between indigenous peoples’ situation in South Africa, Kenya and Australia.
In the light of the above, the thesis argues that the protection of indigenous peoples’ rights to land as well as other rights which are all associated to land has to start from the understanding regarding the special connection indigenous peoples have to their territories.
