Title Bleedout as a type of bankruptcy crime:comparison of Russian and US law
Summary This paper focuses on the bleedouts - fraudulent scheme used in bankruptcy proceedings aimed at depletion of assets. After the sort overview of the role of bleedouts in the system of bankruptcy crimes, the thesis deals with the definition of the bleedout bankruptcy scheme and its distinctive features. The historical introduction to the evolution of fraudulent schemes regulation is made.
The civil and criminal provisions regulating the bankruptcy schemes in both countries are scrutinized. Taking the US law as t he pattern the comparison analysis of US and Russian regulation is made in order to elaborate the possible improvements of Russian law on fraudulent bankruptcy schemes. The findings of thesis on modification of Russian bankruptcy law are of vital importance in the light of Russian civil law reform and increased number of the liability avoidance among parent companies.
