Title Joinder of Multiple Disputes between the Same Parties: Issue of Single Arbitration
Summary International commercial arbitration is alternative dispute resolution mechanism that is based on the parties’ agreement. Joinder is a special tool of complex arbitration that allows joining separate disputes arising out of interrelated contracts. This paper analyzes the nature of joinder, its features and preconditions. It provides with overview of possibility to join different disputes in a single set of proceedings. Such possibility is connected with expressed or implied consent of the party for joinder. This work summarizes the indicators of the parties’ intent, which were developed by the case law and scholars’ works. Moreover, special attention is given to ensuring the parties' rights in case of the joinder.
