Summary Custodial interrogation is a very old but a living weapon of the police for obtaining incriminatory confessions from the accused himself. Studies claim that a high majority of cases are resolved on the basis of self incriminatory confessions obtained through custodial interrogations. Not surprisingly, the interrogation process exposes detainees to a wide range of human right violations. Indeed, courts are increasingly confronted with allegations for violation of human rights during custodial interrogation process.
Whether we call it hypocrite, courts and governments are confident that the wellbeing of detainees can be ensured by setting up procedural and substantive safeguards. This thesis as well accepts the view that regulating the interrogation process by law and putting in place strong institutional safeguards can improve police conduct and thereby reduce improper interrogation tactics. In this regard, therefore, the thesis investigates the legal safe guards and institutional mechanisms that shape and govern the interrogation process in Britain and Ethiopia. The thesis also assesses the legal redress against harm caused during interrogation process.
The thesis observes that while Britain provides comprehensive and strong statutory regulatory mechanisms, the interrogation process in Ethiopia is largely untouched either by the statutory or self regulatory mechanisms. Besides this, the thesis reveals that the existing laws that guide interrogation process in Ethiopia are too general and lack clarity to protect detainees against systematic abuses during custodial interrogation.
