Title Application of Russian Administrative legislation in protecting Environment
Summary The project looks at the divide between theory and practice in the application of administrative legislation in the Russian legislation in protecting the environment. The practical side of the legislation is shown using the Rostov region as an example. An analysis of definitions of various types of legal liability related to the environmental protection was undertaken. It is shown that the legislation provides for a broad range of administrative punishments for environmental offenses. These violations were then classified. The system of federal and regional bodies responsible for environmental protection was reviewed and how they operate.
Amongst many environmental bodies, the state environmental control is considered as one of the most important tools to protect the environment. The analysis of its work, functions, responsibilities, and types of inspections conducted by it was done. The analysis of the Administrative Code of the Russian Federation was made and its articles are used to decide on the punishments in the quest for state environmental control.
The results of the inspections over the compliance with environmental legislation were presented. Analysis of imposed punishments revealed positive and negative aspects of environmental legislation. Although there is a tendency to reduce environmental offenses, the main targets of environmental supervision are small businesses. They do not have a significant negative impact on the environment.
Project concludes that the scope of environmental control over companies engaged in different activities should expand and the punishment for damaging the environment should toughen. These issues require consistency of supervisory bodies, law enforcement and judicial authorities as well as supervisory bodies, administrative and law enforcement authorities need to increase cooperation with non-governmental and environmental organizations. It should be noted that the system of environmental funding must be improved.
