Title Cramdown in U.S. Bankruptcy law: Lessons for Hungary
Summary European countries and even the European Union are amending their bankruptcy laws continuously to increase the likelihood of the companies’ continuation in an insolvency situation. This thesis is dealing with problems that are well-known by European insolvency experts: the difficulties surrounding the acceptance of a reorganization plan by the creditors. Reorganization preserves the value of the company as a going concern while helps to the employees’ to keep their job and to the state to maintain the existence of a tax payer.
The central issue of this paper is what the Hungarian legislators could learn from the experience of the more advanced US bankruptcy system.
