| Title | Investment status of sovereign bonds: recent developments in the case law of ICSID |
| Summary | The work analyzes a question whether and in which cases sovereign bonds (security entitlements) can be disputed before the International Centre for Settlement of Investment Disputes ("ICSID"). Two main issues that it discusses are whether sovereign bonds are investments under the article 25 (1) of the ICSID Convention as well whether and in which cases they can be regarded as investments under the investment treaties, by analyzing three ICSID cases, namely - Abaclat and Others v. Argentine Rep. (formerly Giovanna a Beccara and others v. Argentine Rep.), ICSID Case No ARB/07/5; Ambiente Ufficio SpA and others v. Argentine Rep., ICSID Case No. ARB/08/9 and Poštova banka a.s. and Istrokapital SE v. Hellenic Rep., ICSID Case No. ARB/13/8. It also touches upon the issue of non - uniform approach with regard to this subject and gives possible solutions to the problem. |
