| Title | Colonial Law of 1862 and the Regulation of Same-Sex Love in Hindu Society |
| Summary | In this thesis, I aim to explain the relation, if any, that exists between the colonial law- Section 377 of the Indian Penal Code- and Hindus’ attitude to same sex love since the nineteenth century. While there are some contemporary Indian scholars who argue that the law brought about a paradigm shift and created new sexual identities in Hindu culture, I argue that the law alone was not responsible for it. In fact, there were institutions such as English education, the printing press and the public sphere that paved the ground for the cultivation of English moral attitude and values in Hindu society. Hence, while the law was certainly important in constructing and consolidating English values, it is equally important to consider the role the institutions played for that effect. This is the length and the breadth of my thesis. The focus, thus, is not so much the law but the institutions which were responsible for changing Hindus’ attitude to same-sex love and to sex and sexuality in general. |
