Summary In recent years, various governments have introduced legislation permitting the access to individuals’ personal data for the prevention of crime, authorising the compelled key disclosure of encrypted electronic devices, and the surveillance of phone and internet communications. This thesis evaluates the impact of such practices on criminal procedure rights, in particular the privilege against self-incrimination and the presumption of innocence, and the resulting effect that this will have on the admissibility of evidence. This is performed through a comparative analysis of the legislation and jurisprudence of the United Kingdom, Germany, and the European Court of Human Rights.
