Summary Asylum-seekers are systematically detained worldwide, and Europe is not an exception. Instead of being provided by safety and assistance, they often face hostile environment and harsh detention conditions. Countries such as Hungary and Italy, have created a series of legislative and policy measures in order to prevent asylum-seekers’ access to their territory by the use of detention. Deprivation of liberty should be a measure of last resort in the field of migration management. The principles of necessity and proportionality, the existence of less coercive measures and the requirement of individual assessment should be the leading motives while deciding on detention. This Capstone Thesis analyzes these aspects through the case studies of Hungary and Italy. It also advocates for the increased use of alternatives to detention as they are capable of upholding human rights.
