Title Detention Conditions that Result in Ill-treatment and Create a Structural Problem in Ukraine and Hungary
Summary The thesis focuses on the existence of the problem with overcrowding and inadequate material conditions of detention in prisons of Hungary and Ukraine that results in the ill-treatment of detainees and constitutes Article 3 violation of the European Convention on Human Rights. The analysis of the relevant standards, case-law and reports identifies the existence of the structural character of the problem in both countries that further leads to the evaluation of effective remedies and pilot judgment procedure.
The analysis of the Hungarian approach to deal with a similar structural problem as in Ukraine leads to the identification of particular actions that could be done by Ukraine.
