Title | Enforcement of International Mediated Settlement Agreements Under Singapore Convention in Comparison to Enforcement of International Arbitration Awards Under New York Convention |
Summary | The most essential motivation for adoption of Singapore Convention was to establish something similar for mediation as New York Convention is for arbitration. The most important achievement of international arbitration compare to international mediation has always been considered its predictability and the guarantees of enforcement. However, after appearance of Singapore Convention, the international mediation has the perspective to reach the same heights as international arbitration does. Accordingly, the intend of the research is to find out, whether the application of Singapore Convention can potentially become as widely used and as successful as it is in case of New York Convention. For the mentioned purpose the paper provides the comparative analyzes of core provisions such as scope for application, general principles and reservations of Singapore Convention in compare to the similar Articles under New York Convention. The paper also compares the main terminological differences and its backgrounds in those two Conventions. |
