Title Last Rights: The Legal Obligation of States to Ensure Post-Mortem Dignity in Cases of Mass Violence
Summary Rituals marking death and celebrating life have been observed by humankind since the dawn of recorded history. In the wake of mass violence such as genocide or war, the ability to observe funerary rites is often stifled. With an eye to recording the truth and facilitating reconciliation, it is in a State's best interest to locate the missing dead, discover the truth about their demise, and return the victims to their families. In this paper, the rights of both the victims and survivors are investigated in the context of the Bosnian War and the Argentine military dictatorship.
