Title | Ameliorating the Protection of the Human Rights of Refugees and Asylum Seekers - What is in Place Within the UN System and What Should Be Improved? |
Summary | The thesis overviews the competence of the UN High Commissioner for Refugees (UNHCR) and analyses the supervisory role of UNHCR primarily based on the Conclusions of the Executive Committee, 1951 Convention Relating to the Status of Refugees (1951 Geneva Convention), and the founding resolution of UNHCR. The analysis demonstrates that the absence of the state reporting and individual complaint mechanisms under the 1951 Geneva Convention undermines the protection of the human rights of refugees and asylum seekers. The thesis also aims to demonstrate, based on the analysis of resolutions, recommendations, the adopted views and other relevant materials, that there are mechanisms available within the UN system, especially within the UN Human Rights Council, which could be utilised for addressing protection issues of refugees and asylum seekers. The thesis, therefore, shows that designating a special rapporteur on the human rights of refugees and asylum seekers could advance the overall protection situation significantly. |
