| Title | EU Accession to the European Convention of Human Rights An Analysis of the Impacts of the 2023 Draft Accession Agreement on the Effectiveness of the Convention System |
| Summary | This thesis analyzes the 2023 Accession Agreement to understand how the objections of the Court of Justice from Opinion 2/13 on the 2013 Accession Agreement are integrated in the new draft. This thesis looks at how the implementation of Opinion 2/13 in the 2023 Accession Agreement impacts the effectiveness and functioning of the Convention system. The effectiveness of the Convention system is defined by the national implementation of the Convention, the authority and supervision of the ECtHR, and the execution of the judgments delivered by the ECtHR. The focus is on how the 2023 Accession Agreement affects the jurisdiction of the ECtHR and the applicability of the Convention to the EU and its member States. This analysis engages ongoing academic debates on the EU Accession to the Convention. |
