Summary This thesis explores the theme of the protection of human rights for rejected asylum seekers in Austria who cannot be returned to their countries of origin due to legal, humanitarian, or safety reasons. It concentrates on the intersection of non-returnability and human rights, researching the difficulties these individuals face and examining Austria's policies within the framework of international human rights commitments. This study aims to provide a better understanding of Austria's approach to non-returnable rejected asylum seekers and its alignment with international standards through qualitative research, such as structured interviews with rejected asylum seekers, representatives from an NGO, a legal professional, and an employee from the ministry of foreign affairs in Austria. The findings seek to contribute to the academic and policy-making discourse on asylum and migration, advocating for reforms that uphold the dignity and rights of non-returnable individuals.
