Summary The COVID-19 pandemic ignited a heated debate on the mandatory vaccination campaign adopted by different Governments, with anti-vax social movements challenging these measures, especially before the courts. In the United States, relevant cases such as Does v. Mills and Dr. A v. Hochul have reached the Supreme Court, while in Italy, Decree-Law 44/2021 has been brought before the Italian Constitutional Court. This thesis examines these events in light of the concept of "Culture War" and how anti-vax groups have promoted this Culture War through the mobilization of the law. By analyzing social and legal contexts, this thesis provides a critical perspective on the relationship between Law and "Culture War" and the implications of observing the COVID-19 "Culture War" through a legal perspective.
