Title Determination, Payment and Allocation of Costs in International Commercial Arbitration
Summary This thesis provides a structural doctrinal analysis of the legal issues related to the determination, payment and allocation of costs in international commercial arbitration. It focuses on theoretical underpinnings of these issues and their practical considerations. Three cost-related stages of arbitration proceedings are analysed in this thesis – determination, payment and allocation. Some of the topics addressed are: the nature and source of the obligation to pay costs in arbitration, national court scrutiny over decisions on costs, the nature of the obligation to pay the advance on costs, the consequences of the non-payment of the advance in arbitration, the prohibitive nature of costs of the arbitration, newly developed industry of third party funding, and the standard of allocation of costs in arbitration. The analysis includes more than ten national arbitration acts and arbitration rules.
